Terms and Conditions

The terms that apply when using Violin Tab App, including memberships, content, and microphone tutor mode.

1. Agreement to these Terms

These Terms and Conditions ("Terms") are a binding agreement between you and New Castle Innovations INC, ("Violin Tab App," "we," "us," or "our"), governing your access to and use of the Violin Tab website at violintab.com, the Violin Tab web application, and any related content, features, and services (together, the "Service").

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts for minors

You must be at least 18 years old to create an account and purchase a subscription.

If you are between 13 and 17, you may use the Service only through an account created and managed by a parent or legal guardian who accepts these Terms on your behalf and is responsible for all activity and charges on the account. A parent or guardian should supervise the child's use of the Service and manage the child's account, billing, and device permissions.

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. A guardian who believes a child provided account or email-interest information without appropriate permission should contact us at classicalviolintab@gmail.com so it can be reviewed and deleted.

3. Your account

Account sign-up, sign-in, and session management are handled by our authentication provider, Clerk. We store the Clerk user identifier needed to connect your account to your Violin Tab data; we do not receive or store your password.

You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Notify us promptly at classicalviolintab@gmail.com if you suspect unauthorized use.

Accounts are for individual use. You may not share, sell, or transfer your account, and you may not use one account to provide access to multiple people.

4. Subscriptions, billing, and cancellation

  • Payment processing. Payments are processed by Stripe, Inc. We store a Stripe customer reference and your subscription status, plan, and renewal information so we can provide paid access — we do not receive or store your full card number. By subscribing, you also agree to Stripe's terms and authorize Stripe to charge your payment method on our behalf.
  • Auto-renewal. Subscriptions are offered on a recurring basis at the price and interval shown at checkout. Your subscription automatically renews at the end of each billing period, and your payment method will be charged the then-current rate, until you cancel. Renewal charges occur without further notice unless required by law.
  • Cancellation. You may cancel at any time from your account settings or by emailing classicalviolintab@gmail.com. Cancellation takes effect at the end of the current billing period. You will retain access until that date, and you will not be charged again after canceling.
  • Refunds. Except where required by law, all fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, or periods during which you did not use the Service. We may issue refunds at our sole discretion.
  • Price changes. We may change subscription prices. We will give you at least 30 days' notice by email before a price change takes effect for your subscription, and the new price will apply at your next renewal. If you do not agree, you may cancel before the change takes effect.
  • Failed payments. If a charge fails, we may retry the charge and may suspend or terminate your access until payment is successfully processed.
  • Taxes. Prices exclude applicable taxes unless stated otherwise. You are responsible for any taxes assessed on your purchase, other than taxes on our income.

5. What you may do with the content

Your license. Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content — including tablature, notation, interactive arrangements, downloadable PDFs, and audio — for your own private, non-commercial musical practice and study.

What you may not do. You may not:

  • redistribute, publish, share, sell, sublicense, or post our tablature, arrangements, PDFs, or audio files, in whole or in part;
  • reproduce our content for classroom, studio, ensemble, or other group instruction without a separate written license from us;
  • use our content to create a competing product or a derivative tablature library;
  • scrape, crawl, bulk-download, reverse engineer, decompile, or attempt to extract the source code, tablature data, or underlying models of the Service;
  • circumvent paywalls, rate limits, authentication, or other technical restrictions;
  • upload malicious code, interfere with the Service's operation, or attempt to gain unauthorized access to our systems or another user's account.

Teachers and institutions. If you are a teacher, school, or studio and wish to use Violin Tab with students, contact us at classicalviolintab@gmail.com about institutional licensing. Individual subscriptions do not cover instructional use with multiple students.

6. Intellectual property

Our rights. The Service, including its software, interface, design, tablature arrangements, notation layouts, curation, fingering annotations, trademarks, and logos, is owned by us or our licensors and is protected by copyright, trademark, and other laws. These Terms grant you no ownership rights.

Underlying musical works. The classical compositions featured in the Service are, to our knowledge, in the public domain in the United States. The public-domain status of a composition does not extend to our tablature arrangements, notation, fingerings, engraving, curation, or to any sound recordings made available through the Service, each of which is separately protected.

Sound recordings. Recordings made available through the Service are used under license from their respective rights holders and remain the property of those rights holders.

Copyright complaints. If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act and CC classicalviolintab@gmail.com: identification of the work, identification of the material you claim is infringing and where it appears, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the information is accurate and you are authorized to act, and your signature.

7. Microphone access and pitch detection

Certain features — including real-time pitch detection, performance scoring, and practice feedback ("tutor mode", “interactive practice studio”) — require access to your device's microphone. You control this permission through your browser or device settings, and you may deny or revoke it at any time, though the affected features will stop working.

Pitch analysis in tutor mode happens live on your own device. We do not record, upload, transmit, or store the microphone audio used by tutor mode, and raw pitch samples are not retained after live analysis. Some favorites, practice preferences, and summary progress metrics may be stored locally in your browser. These local values do not include microphone audio or raw pitch samples, and clearing your browser data removes them.

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms.

8. Changes to the Service

We may add, modify, suspend, or discontinue features, content, or individual pieces in the library at any time. We may remove a work from the library — for example, if a licensing arrangement ends. The library size and specific titles available are not guaranteed for the duration of your subscription.

9. Termination and account deletion

9.1 Deleting your account

You can delete your account at any time: sign in, open Account, choose Delete account, review the consequences, and confirm by typing DELETE. Completing this cancels your active Violin Tab App subscription, retires the Stripe customer record used for this product, deletes your Clerk identity and local account mapping, removes matching email-interest entries, and removes any legacy submission or recording objects associated with your account.

Account deletion is permanent and does not by itself entitle you to a refund. Stripe and our other service providers may retain transaction or security records where required by law. If you cannot sign in, use the public support and deletion instructions at classicalviolintab@gmail.com.

9.2 Termination by us

We may suspend or terminate your account, with or without notice, if you breach these Terms, if we suspect fraudulent or unlawful activity, or if we discontinue the Service. If we terminate your account for a reason other than your breach, we will refund the unused portion of your current billing period.

On termination, your license under Section 5 ends immediately, and you must stop using and delete any downloaded PDFs.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, that pitch detection or scoring will be accurate, or that the tablature and fingerings are free of errors.

Violin Tab is a practice aid, not a substitute for instruction from a qualified teacher. Playing a stringed instrument carries a risk of physical strain or injury. You are responsible for your own practice habits, posture, and physical wellbeing, and you should consult a teacher or medical professional about any pain or discomfort.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PRACTICE PROGRESS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless New Castle Innovations INC. and its DBAs, officers, employees, and agents from any claims, damages, losses, and reasonable legal fees arising out of your use of the Service, your violation of these Terms, or your infringement of another party's rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Clark County, Washington, and you consent to personal jurisdiction there.

14. Changes to these Terms

We may update these Terms. If the changes are material, we will notify you by email or through the Service at least 30 days before they take effect. Continued use after the effective date means you accept the updated Terms. If you do not accept them, cancel your subscription before they take effect.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
